Terms of Service

These terms explain the responsibilities shared by RubyNav Inc., adult account organizers, and family members when Zahara is used.

Important launch notice

Zahara mobile applications and some device-management capabilities are in development or pre-release. A feature is available only when it appears as active in the Service and the applicable device, operating system, enrollment, and permission requirements are met.

1. Agreement and provider

These Terms of Service (“Terms”) are a legal agreement between you and RubyNav Inc., 15322 Marek Lane, Guy, Texas 77444, United States, concerning the Get Zahara website, Zahara Parent, Zahara Child, and related software and services (the “Service”). By using the Service, you agree to these Terms and the Privacy Policy.

If you use Zahara for a child, you represent that you are at least 18, are the child's parent or legal guardian or otherwise have lawful authority, and accept these Terms for the supervised use.

2. Accounts and family roles

  • The adult organizer is responsible for accurate registration, protecting credentials, selecting trusted adults, and configuring each enrolled device.
  • Child profiles must be created and supervised by an authorized parent or legal guardian. Required parental notices and consent must be completed before protected child features are activated.
  • An adult family member aged 18 or older controls their own account and must affirmatively enable any trip, location, speed, or wellbeing sharing.
  • You must promptly tell RubyNav Inc. if an account or enrolled device may have been accessed without authorization.

3. License and acceptable use

RubyNav Inc. grants a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for lawful family-safety purposes while these Terms remain in effect.

You may not use Zahara to:

  • monitor an adult without their knowledge and legally required consent, stalk, harass, intimidate, or facilitate abuse;
  • misrepresent parental or legal authority, secretly enroll a device, or bypass visible consent and notice controls;
  • access another family's information, probe security, introduce malicious code, overload the Service, or interfere with safeguards;
  • violate privacy, communications, employment, education, child protection, export, sanctions, or other applicable law; or
  • reverse engineer, resell, sublicense, scrape, or copy the Service except where law expressly permits.

4. Device controls and platform limits

Screen-time enforcement, app restrictions, internet pause, device lock, Safe Web, location, screen help, secure-tunnel features, and similar controls depend on the device platform, enrollment method, network, permissions, app-store rules, and third-party availability. RubyNav Inc. does not promise that every control works on every device, blocks every harmful item, or cannot be bypassed.

You are responsible for checking active status, maintaining operating-system and network settings, and using controls in a lawful and age-appropriate way. Zahara must not be used as covert spyware or as an employer-surveillance tool.

SAFETY BOUNDARIES

5. Communications, AI, location, and emergencies

Family messages, calls, recommendations, alerts, content categories, Safe Search, and AI suggestions can be delayed, incomplete, or incorrect. They do not replace attentive parenting, professional advice, cybersecurity services, or independent judgment.

Zahara family panic and safety features notify configured contacts only as described in the active feature. They do not guarantee delivery and do not contact 911, police, fire, ambulance, or another public emergency service unless a separately identified, certified integration expressly confirms that action. In an emergency, contact local emergency services directly.

6. Plans, billing, and cancellation

Prices displayed before public checkout are launch pricing and may change before purchase. When paid plans become available, the checkout screen will show the final price, billing interval, taxes, renewal terms, and cancellation method before purchase. Apple, Google, or another payment provider may process the transaction under its own terms.

Canceling a subscription stops future renewal but does not by itself delete a Zahara account. Deleting an account does not automatically cancel a store-managed subscription. Complete both steps where applicable.

7. Ownership and feedback

The Service, brand, interface, software, documentation, and related intellectual property belong to RubyNav Inc. or its licensors. Families retain rights in the information they provide. If you submit feedback, RubyNav Inc. may use it without restriction or compensation while protecting personal information under the Privacy Policy.

8. Suspension, termination, and deletion

RubyNav Inc. may restrict or suspend access when reasonably necessary to address security, unlawful use, harm, nonpayment, or a material breach. Where practical, notice and an opportunity to resolve the issue will be provided.

You may stop using the Service at any time and may request account deletion through the deletion page. Sections intended by their nature to survive—such as ownership, accrued payment obligations, warranty limits, and dispute provisions—continue after termination.

9. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available.” RubyNav Inc. disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Some jurisdictions do not allow certain disclaimers, so these limits may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, RubyNav Inc. and its directors, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, profits, goodwill, or business opportunity, arising from the Service. Liability that cannot legally be excluded remains limited only to the extent the law permits.

These Terms do not limit rights or remedies that cannot be waived under applicable consumer law.

11. Governing law and changes

Texas law governs these Terms without regard to conflict-of-law principles, except where the law of your residence requires otherwise. Before filing a formal claim, please contact RubyNav Inc. so the parties can try to resolve it informally. Any court proceeding must be brought in a court with lawful jurisdiction.

RubyNav Inc. may update these Terms. Material changes will be posted with a new effective date and, when required, notice or renewed acceptance will be provided.
